Introduction

HPC Standards Inc, a Georgia corporation (referred to in this Privacy Policy as "we," "us," "our" or the "Company"), operates this website, including the web pages and services delivered through the domain hpc-standards.us (the "Site"). We understand your concerns about privacy and are committed to protecting it through our compliance with this policy.

This Privacy Policy describes the types of information the Company may collect from users ("users" or "you") or that users may voluntarily provide to the Company when they use the Site and in email, and other electronic messages between the users and the Site, and our practices for collecting, using, maintaining, protecting and disclosing that information. This Privacy Policy does not apply to: (i) information collected by the Company offline or through any other means, including any other website operated by the Company or any third party (including our affiliates and subsidiaries); or (ii) any third party (including our affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or on the Site.

Changes to This Privacy Policy

The Company may modify this Privacy Policy from time to time in our sole discretion. We will provide notice by, at a minimum, updating this posting. You are expected to carefully review this Privacy Policy from time to time so you are aware of any changes. If we make material changes to this Privacy Policy, we may notify you either through the email address you have provided us or by means of a prominent notice on the Site before the change becomes effective. Any changes to this Privacy Policy will be in effect as of the "Last Updated" date referenced in this Privacy Policy. By accessing or using this Site, you agree to be bound by any such changes and to the Company’s collection and sharing of your personally identifiable information according to the terms of the then-current Privacy Policy.

Information We Collect

We collect information you share through the Site. We may collect personally identifiable information, such as your name, email address, or any other identifier by which you may be contacted online or offline ("PII") only when you have voluntarily provided such PII to us (e.g., through contact inquiries,). We may also collect information concerning you, including, but not limited to, records and copies of your correspondence, if you contact us.

We use information that we collect about you or that you provide to us, including any PII:

• To present the Site and its contents to you.
• To provide you with information that you request from us.
• To fulfill any other purpose for which you provide it.
• To carry out our obligations and enforce our rights arising from any contracts entered into between you and us.
• To notify you about changes to the Site or any services we offer or provide though it.
• In any other way we may describe when you provide the information.
• For any other purpose with your consent.

We may use analytics technologies or other similar technologies (the "Analytics Technologies") to collect and process certain information about you and your use of the Site. Our web server and/or the Analytics Technologies may collect and store the following general information about you: the originating name of the domain from which you access the Internet; the date and time you access the Site; the pages of the Site you visit; the Internet address of the website from which you linked directly to us; and the type of device, device ID and web browser you use to access the Site. This information is collected automatically. It is used to help us improve the Site by tabulating the number of visitors to the Site in terms of new users, origin of referrers, popularity of pages, amount of use, types of errors, and to make the Site more useful to you.

Our web server and/or the Analytics Technologies may also collect Internet protocol addresses (the Internet address of a device) to track a user’s session while the user remains anonymous. We analyze this data for certain trends in statistics, such as which parts of the Site users are visiting and how long they spend there.

We may also use "cookies" and "web beacons." Cookies are small files stored on your device or your computer's hard drive that are used to store and track personal information. Cookies are used to remind us of who you are in order to deliver you better service. Web beacons are small electronic files (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited certain pages and for other related Site statistics (for example, recording the popularity of certain Site content and verifying system and server integrity).

Do Not Track Policy

We may also use automatic data collection technologies to collect information about your online activities over time and across third-party websites or other online services ("Behavioral Tracking"). "Do Not Track" is a proposed standard that is currently under development. As it is not yet finalized, we adhere to the standards set out in this Privacy Policy and we do not currently respond to "Do Not Track" signals on the Site or on third-party websites or online services where we may collect information. The information we collect automatically is statistical data and does not include PII, and we do not maintain it or associate it with PII we collect in other ways or receive from third parties.
When you install our systems to help automate your house, we may receive information that you or your installer inputs into your configuration project file which may include: the model and serial numbers of the Company products installed; the version and type of any software installed; the type of third-party devices you integrate; the names of the rooms where you have connected devices; your zip code or time zone; and other information about your configuration.

Some content, including advertisements, on the Site may be served by third-parties, including advertisers, ad networks and servers, and content providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our Site. The information they collect may be associated with your PII or they may collect information, including PII, about your online activities over time and across different websites and other online services. They may use this information to provide you with targeted content.

We do not control these third parties' tracking technologies or how they may be used. If you have any questions about targeted content, you should contact the responsible party directly.

Communications

We may use your PII to contact you with newsletters, marketing or promotional materials and other information that is pertinent to the use of the Site or the services we offer. By using the Site, you are consenting to this.

Newsletters

We offer a free electronic newsletter to website visitors. We gather the email addresses of Site visitors who voluntarily subscribe. Site visitors may remove themselves from this mailing list by following the link provided in every newsletter that points Site visitors to the email preference center.

Surveys

We may occasionally send user surveys to improve and optimize content delivered to the Site visitors. We sometimes share the collected demographic information in these surveys with our sponsors, advertisers and partners. Except for trusted third-party vendors performing services for or on behalf of us, we never share any demographic information about specific individuals with any unaffiliated third parties.

What Information is Shared and With Whom

We do not rent or sell your information, including your PII, to outside marketers. The Company may share your information (as described in this Privacy Policy) with its affiliates, subsidiaries, or divisions and with their respective officers, directors, employees, accountants, attorneys, and agents, or with the Company’s business partners. In certain circumstances, we may share data with vendors to help us develop and/or operate the Site, provide you with services that you requested from us, perform statistical analysis, send you email or postal mail, provide customer support, or enforce or apply our Terms of Use and other agreements. All such third parties are required to maintain the confidentiality of your information and are prohibited from using your PII except to provide services to us or as required by law.

We may provide information to regulatory authorities and law enforcement officials in accordance with applicable law or when we otherwise believe in good faith that the law requires it. There may be instances when we may access or disclose your information in order to protect or defend the legal rights or property of the Company and its affiliated companies or their employees and agents, to protect the safety and security of users, and to protect against fraud.

The Company may sell, transfer or otherwise share some or all of its assets in connection with a merger, reorganization or sale of assets, or in the event of bankruptcy, without your permission. In such an event, PII may be one of the assets transferred.

The Site is developed and supported by third-party vendors, who may in the course of performing their services for us have access to your PII. We contractually require such vendors to maintain the confidentiality of your PII, and keep your PII secure. We do not allow such vendors to use or share your PII for any purpose other than in performing services for us.

Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the PII you provide to us. We have created mechanisms to provide you with the following control over your information:

• Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of the Site may then be inaccessible or not function properly.
• Disclosure of Your Information for Third-Party Advertising. The Company does not share your PII with unaffiliated third parties for promotional purposes.

Data Security

The security of your PI is important to us. We follow generally accepted industry standards to protect the data submitted to us in a secure and encrypted environment, both during transmission and once we receive it. Your personal information is shared with our employees, contractors and affiliated organizations who are bound to keep it confidential and solely access that information for the purposes described in this Privacy Policy, such as providing you with the services that you have requested from us or are available on the Website.

HOWEVER, THIS IS NOT A GUARANTEE THAT SUCH INFORMATION MAY NOT BE ACCESSED, DISCLOSED, ALTERED, OR DESTROYED IN THE EVENT OF A SECURITY BREACH. BY USING THE WEBSITE, YOU ACKNOWLEDGE THAT YOU UNDERSTAND AND AGREE TO ASSUME THESE RISKS.

The safety and security of your information also depends on you. Where we have given you (or you have chosen) a password for access to certain parts of the Website, you are responsible for keeping this password confidential. Do not share your password with anyone besides authorized users of your account. We also recommend that you change your passwords often and use a secure web browser.

E.U. General Data Protection Regulation

Company complies with the E.U. General Data Protection Regulation, 2016/679 (the "GDPR") for users from the EU.

Updating Your Personal Information

If any of the personal information you provided to us changes, please let us know. For instance, if your email changes, you wish to cancel any request you have made of us, or if you become aware of inaccurate personal information about you, use our Contact Us (below) details to update your information. You may also edit your account details if you have a user account through our Site.
We are not responsible for any losses arising from any inaccurate, inauthentic, deficient or incomplete personal data that you provide to us.

Your Rights To Access And Control Your Personal Information

Please use the Contact Us details at the end of this Policy to exercise your rights and choices under this Policy.

Right of Access. If required by law (e.g., under U.S. state or federal privacy and data protection laws and other Data Protection Laws), upon request, we will grant reasonable access to the personal information that we hold about you.

Right to Object. In certain circumstances, as permitted under applicable law, you have the right to object to processing of your personal information and to ask us to erase or restrict our use of your personal information. If you would like us to stop using your personal information, please contact us and we will let you know if are able to agree to your request.

Right to Erasure and Deletion of Your Personal Information. You may have a legal right (e.g., if you are located in the European Union (the "EU") or European Economic Area ("EEA")) to request that we delete your personal information when it is no longer necessary for the purposes for which it was collected, or when, among other things, your personal information has been unlawfully processed. All deletion requests should be sent to the address noted in the Contact Us section of this Policy.

We may decide to delete your personal information if we believe it is incomplete, inaccurate or that our continued storage of your personal information is contrary to our legal obligations or business objectives. When we delete personal information, it will be removed from our active servers and databases and our Site, but it may remain in our archives when it is not practical or possible to delete it. We may also retain your personal information as needed to comply with our legal obligations, resolve disputes, or enforce any agreements.

Right to Withdraw Consent. If you have provided your consent to the collection, processing and transfer of your personal information, you have the right to fully or partially withdraw your consent. To withdraw your consent, please notify us using the information in the Contact Us section of this Policy and you may follow opt-out links on any marketing communications sent to you.

Once we have received notice that you have withdrawn your consent, we will no longer process your personal information for the purpose(s) to which you originally consented unless there are compelling legitimate grounds for further processing that override your interests, rights and freedoms or for the establishment, exercise or defense of legal claims.

Withdrawal of consent to receive marketing communications will not affect the processing of personal information for the provision of our services.

European Union or European Economic Area Residents. If you are located in the EU or EEA and believe we have not processed your personal information in accordance with applicable provisions of GDPR, you may lodge a complaint with your local data protection or supervisory authority.

Cross Border Transfers of Personal Information

Company is located and established in the United States and therefore, your personal information may be transferred to, stored or processed in the United States. While the data protection, privacy and other laws of the United States might not be as comprehensive as those in your country, we take necessary and appropriate steps to protect the security and privacy of your personal information. By using our Site or requesting services from us, you understand and consent to the collection, storage, processing and transfer of your personal information to our facilities in the United States and those third parties with whom we share it as described in this Policy.

Because of the dynamic media capabilities of the Site, it may not be clear to you which links are embedded in the Site and which are embedded in third-party media and/or content. The Company cannot and does not guarantee the privacy policies and practices of any third party. The Company does not control, operate, or endorse any information, products, or services of any third-party websites that may be reached through links from the Site.

We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them. Protecting Children

The Site is not intended for children under 13 years of age. The Company does not knowingly collect PII from children under 13. If you are under 13, do not use or provide any information on the Site or provide any information about yourself to us, including your name, email address, or any screen name or user name you may use. If we learn we have collected or received PII from a child under 13 without verification of parental consent, we will delete that information. Access and Update Your Information

If you have any questions about PII that may be retained by the Company, you may contact us at sales@hpc-standards.us. Upon your request, the Company will provide to you the PII under its control, if any, as well as information about the ways in which that information is being used and disclosed. The Company only collects PII for the purposes of providing you with services that you requested from us and the support of those services. The Company will use commercially reasonable efforts to ensure that PII we may be using or disclosing is accurate and complete. If you demonstrate that your information is inaccurate or incomplete, the information will be amended as appropriate. We will use commercially reasonable efforts to respond to any request and update your PII, if necessary.

Your California Privacy Rights

California Civil Code Section § 1798.83 permits users of the Site that are California residents to request certain information regarding our disclosure of PII to third parties for their direct marketing purposes. To make such a request, please contact us at sales@hpc-standards.us. Please note, however, that the Company does not disclose PII to third parties for their direct marketing purposes.

Governing Law

This Privacy Policy and any disputes related thereto shall be governed by and construed in accordance with the laws of the State of Georgia, exclusive of its choice of law rules, whose courts shall have exclusive jurisdiction over all disputes arising in connection with this Privacy Policy and the place of performance of this Privacy Policy is agreed by you to be the State of Georgia.
